Orchard is managed by Bushburg Properties, Inc. ("we," "us," "our"). This Privacy Policy explains how we handle information that identifies or could reasonably be linked to you ("Personal Information") when you use orchardjc.com, contact our leasing team, or tour the property. By using the site, you agree to this Policy.

Information We Collect

You provide: name, email address, telephone number, desired move-in date, unit preferences, and anything else you include in an inquiry, form, or conversation.

Collected automatically: IP address, browser and device type, pages viewed, referring URL, date and time of access, and cookie identifiers.

From other sources: apartment listing sites and lead aggregators, brokers and locator services, and our leasing, chat, and marketing platforms.

The site does not process rental applications or payments. If you apply for a residence, your application is handled separately and is subject to the disclosures and authorizations you receive at that time.

How We Use It

We use Personal Information to respond to inquiries, provide availability and pricing, schedule and conduct tours, communicate with you about the property, operate and improve the site, measure marketing performance, deliver advertising, comply with legal obligations, and prevent fraud and unauthorized access.

Telephone and Text Messages

By providing your telephone number, you consent to receive calls and text messages from us and our leasing agents at that number, including messages sent using an automatic telephone dialing system or a prerecorded voice, about your inquiry, tours, and availability. Consent is not a condition of renting. Message and data rates may apply and message frequency varies. Reply STOP to opt out and HELP for assistance.

Cookies

The site uses cookies, pixels, and similar technologies for core functionality and security, analytics, advertising and retargeting, and embedded leasing tools. Most browsers let you refuse or delete cookies, though this may affect how the site works. We honor recognized browser opt-out preference signals, including Global Privacy Control, where required by law.

How We Share It

We may share Personal Information with service providers that perform functions on our behalf (hosting, lead processing, CRM, email and text delivery, analytics, advertising); the property owner and entities under common ownership or control with us; leasing agents and on-site staff; professional advisors; a successor in connection with a sale, financing, or transfer of the property or our business; and government authorities where required by law or necessary to protect our rights or the safety of others. We limit access to those who reasonably need it.

Text messaging carve-out. Notwithstanding anything else in this Policy, we do not share text messaging opt-in data or consent, or the mobile numbers associated with them, with any third party or affiliate for marketing or promotional purposes. Such information goes only to the vendors that help us deliver text messages, including messaging platforms and carriers. All other categories of sharing described above exclude text messaging opt-in data and consent.

We do not sell Personal Information for monetary consideration. Some of our advertising and analytics practices may count as a "sale" or "sharing," or as processing for "targeted advertising," under certain state privacy laws; text messaging opt-in data is excluded from any such sale or sharing.

Retention, Security, and Third-Party Sites

We keep Personal Information as long as needed for the purposes above and to meet legal and recordkeeping obligations. We maintain administrative, technical, and physical safeguards, though no system is completely secure. The site links to and embeds third-party services, including Google Maps and third-party leasing tools; this Policy does not govern them.

Your Choices and Rights

Every commercial email includes an unsubscribe link. Reply STOP to any text to stop receiving texts. We may still contact you about an active inquiry, scheduled tour, or pending application.

Depending on where you live, you may have the right to access, correct, delete, or obtain a copy of your personal data; to opt out of its sale or sharing or its use for targeted advertising; and to appeal a denial of a request. New Jersey, California, Colorado, Connecticut, Virginia, and other states provide some or all of these rights, and you may not be discriminated against for exercising them. The site is not directed to children under 16, and we do not knowingly collect their Personal Information. Contact us if you believe we have and we will delete it.
